1. Who we are

Bimetis LLC ("Bimetis", "we", "us") operates the Bimetis mobile application. Contact: support@bimetis.fit.

2. Age requirement

Bimetis is intended for users who are 18 years of age or older. We do not knowingly collect personal data from anyone under 18. If we learn that we have collected data from a user under 18, we will delete it promptly.

3. What personal data we collect

The personal data Bimetis collects depends on how you interact with the Bimetis mobile application. In general, we may collect the following categories of personal data:

Account data — such as name, email address, PIN hash
Fitness and health-related data — such as workout logs, set/rep/load records, exercise history, gym equipment list, training goals, training split, experience level
Device information — such as device IDs, device location.
Age-band information — such as whether you are 50 or older (binary yes/no, or "prefer not to say"), used solely for exercise personalization and safety recommendations.
Injury and health disclosures — such as any injury or health information you voluntarily provide to customize your program
Subscription data — such as subscription status and renewal dates (processed by Apple App Store / Google Play; we do not store payment card information)
AI interaction data — such as your training profile, goals, and workout history.
Usage and diagnostic data — such as app crashes and error events to improve reliability

We may collect this personal data directly from you, from automated technologies (such as those installed on your devices), and from third parties (such as social media platforms with which you engage).

4. Consumer health and fitness data

Because Bimetis collects workout history, training goals, injury information, and age-band data, and uses that data to tailor exercise recommendations, some or all of this information may constitute consumer health data under applicable state laws (including, for example, Washington's My Health My Data Act and similar statutes in other states). 5. How we use your personal data

We use your personal data in the following ways:

To generate and update your AI-powered training program
To tailor exercise selection based on age-band and any injury information you provide
To sync your workout history across sessions
To verify your subscription status
To diagnose and fix technical issues
To communicate with you, including to display ads and send you marketing and content that we think may be of interest to you
To create and maintain your account
To improve our services and offerings
For legal, safety, and security reasons
For other internal business purposes, such as operating our business, maintaining business records, enforcing our policies and rules, auditing, and IT security and administration

6. Where your personal data is stored and how is it secured

Your data is stored in databases located in the United States.

We maintain reasonable physical, technical, and administrative measures designed to protect your personal data. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted through the online services.

7. AI processing — Anthropic / Claude

Your training profile, goals, and workout history are transmitted to Anthropic, PBC ("Anthropic") to generate and adapt your training programs using Anthropic's Claude AI. Anthropic acts as a data processor on our behalf and processes this data solely in accordance with our agreement with Anthropic to provide services to us.

8. How we disclose your personal data

We may disclose your data to third parties in the following circumstances:

Third-party service providers that help us operate our business, such as for subscription management and billing event processing, crash/error reporting, cloud infrastructure and database hosting, and product analytics.
Other entities in connection with a corporate transaction, such as if we acquire, or sell or transfer all or a portion of our business or assets including through a sale in connection with bankruptcy and other forms of corporate change.
Partners who collaborate with us on promotional opportunities, including co-branded products and services.
Other entities for which you've consented to the disclosure.

9. Personal data retention

Your personal data is retained for as long as your account is active and for as long as we need it for our legitimate business purposes or for other legal reasons. Aggregate, anonymized analytics data may be retained indefinitely.

10. Cookies

We may collect information by automated means such as through cookies, web beacons, log files, local storage, and similar technology (collectively, "cookies"). We use these technologies to uniquely identify users and store information or settings in / retrieve such information from the user's browser / device. The categories of tracking technologies we use depend on the website you visit, but will generally fall into one of the following categories:

Necessary. These technologies are strictly necessary for you to use our services, load, and view content, and access your account. Without these cookies, our services will not perform as smoothly for you as we would like them to, and we may not be able to provide certain features you request.
Functional. These are cookies that help enhance functionality, improve your user experience, and tailor your use of our services.
Performance. These cookies allow us to understand more about how visitors use our services so we can understand and improve performance. For example, we gather analytics to help us understand which pages within our services are most popular and how users move around them.
Marketing. These are cookies used for targeted advertising and marketing. These cookies may be set by our advertising partners, who may use cookies to build a profile of your interests and show you relevant ads on other platforms.

11. Your rights

Depending on where you live, you may have the following rights under the consumer privacy laws in your state:

Right to access: You have the right to confirm whether we are processing your personal data and to access such personal information.
Right to correct: You have the right to request that we correct inaccurate personal data that we maintain about you.
Right to delete: You have the right to request that we delete your personal data under specific circumstances.
Right to opt-out: You have the right to object or opt out of certain types of processing, including: (1) targeted advertising, (2) sale of personal data, and (3) certain types of profiling and automated decision-making.
Right to data portability: You have the right to request a copy of your personal data in an accessible format.
Right to appeal: If we do not grant your consumer request, you may have the right to appeal that denial.

To make a request, contact us at support@bimetis.fit. We will take steps to verify your identity before processing certain requests. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected personal data. We may request additional information about you to verify your identity. We will only use the personal data provided in the verification process to verify your identity or authority to make a request and to track and document request responses unless you initially provided the information for another purpose.

You may be able to use an authorized agent to submit a rights request on your behalf. When we verify your agent's request, we may verify both your and your agent's identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your personal data, we reserve the right to deny a request from an agent that does not submit proof that you have authorized them to act on their behalf.

If you exercise any of your privacy rights, we will not discriminate or retaliate against you.

Residents of California have rights under the "Shine The Light" law to request and obtain from us, once a year and free of charge, information about categories of personal data (if any) we disclosed to third parties for those third parties' direct marketing purposes. You may opt out of these disclosures by writing us at support@bimetis.fit.

12. Children (COPPA)

Bimetis is not directed at children. We require users to confirm they are 18 or older before creating an account. We do not knowingly collect personal data from anyone under 13. If you believe we have inadvertently collected data from a child under 13, please contact us immediately at support@bimetis.fit.

13. International transfers

If you access Bimetis from outside the United States, your personal data will be transferred to and processed in the United States. By using the app, you consent to this transfer. We take reasonable steps to ensure your data is treated securely.

14. Changes to this policy

We will notify you of material changes via email or an in-app notice before the change takes effect. The effective date at the top of this page reflects the date of the most recent update.
